The Services Offered by Midas
Midas provides wireless mobile products, including but not limited to ringtones, graphics, mobile games, information services and other data downloadable through the mobile internet and short messaging services. You will be able to download/access applicable, compatible products and services through the service offered. This is subject to registration with the service and payment of the relevant fees.
Privacy
Midas believes that your personal information is important. We handle your personal data with great care. We collect a variety of information in order to provide and to enhance the service we offer. Information such as your mobile number and mobile network are logged to process your order. We also store information on products you have ordered and any customer service enquiries you have logged with Midas. This information is stored in order for us to provide you with a high quality of service.
We also use this information to inform you of both new and existing products and services which may be of interest to you. Other purposes we use the data for include analysing product sales and producing sales forecasts. We also use this information to help us develop new products for the future.
Access to the Midas service
To use the service which Midas offers you must be 16 years or older and have the bill payers permission.
To use this service you must have a compatible mobile handset which is connected to a mobile network. Some of the services require a WAP and/or GPRS connection. It is your responsibility to ensure that your phone is compatible and can receive the products or services your order through this service.
When you apply to register Midas will provide you access to the service by allocating you a user ID and a password, at this point Midas will register you as a user of this service. It is possible that you may use the service without registering on-line, Midas also registers you as a user when you order by sms (text message), this method is commonly used but not limited to print promotions and television commercials. The terms of this agreement apply to all registered users.
Midas reserves the right to terminate your subscription at any point.
You use this service at your own risk. You must comply with the terms and instruction given by Midas.
You are fully responsible for payment of all fees concerning your account accessed through your username and password.
The monthly and weekly fees for all services are available at Midas's web site. You shall pay Midas for the Services you have subscribed to in accordance with the stated price at the time you ordered the service. The charges shall be invoiced on the bill you receive from your mobile operator.
Midas reserves the right to change these terms at any time. It is your responsibility to check for these changes. If you do not agree with these changes your can cancel your account as a user. Midas will have deemed you to have accepted these changes if you fail to unsubscribe within 20 days of the changes appearing in the terms of service.
The Terms of this agreement and the relationship between you and Midas shall be governed by the laws of Scotland without regard to its conflict of law provisions. Midas's failure to pursue any claims/defense in relation to this Agreement or otherwise does not constitute a waiver of such claims or defense.
